ARCHITECTURE - Energy Performance Certification





What the Energy Performance Certificate is all about? 

The entry into force of the Royal Decree 235/2013, that arose from the EC Directive 2002/91/EC, establishes the obligation to deliver to purchasers and tenants of buildings the Energy Performance Certificate (EPC). 

It is a report that evaluates how efficient a building is in terms of energy consumption as well as its emission of pollutants under normal operating conditions.
  
What is the Energy Efficiency Label? 
The Certificate carries a Energy Efficiency Label which assigns an energy rating to each bluilding on a scale which ranges from "A" the most efficient buildings) to "G" (least efficient buildings). 



When will this come into effect? 

It will be obligatory to obtain this certificate from the 1st of June 2013.

Which properties will be affected?

It will be compulsory for all new and existing homes, commercial establishments and buildings which come onto the market, whether for sale or for rent, to have this certificate.

Only industrial buildings, insulated buildings with a total living surface of less than 50 m2 and residential buildings whose use is less than 4 months a year or with expected energy consumption of less than 25% of which would be of use troughout year, will not need the Energy Performance Certificate. 

Who is responsible for obtain it?

It is the obligation of the owner of the property to be sold or rented to obtain and keep the Energy Performance Certificate.

For the sale of the property, the owner must provide the purchaser with the original Energy Performance Certificate at the notary's office.

In contrast, when the property is leased, only a copy of the Energy Performance Certificate should be shown to the the lessor by the owner. 

How long is the Energy Performance Certificate valid for?

The Energy Performance Certificate is valid for 10 years. During this period, owners will not have to obtain a new certificate unless they renovate or change the property in any way.
  
Will I be able to sell, rent or advertise a property without the Energy Performance Certificate?

No you won't. From the 1st of June 2013 every property being marketed for sale or rent will require an Energy Performance Certificate, which must be included in the advertisement, whether online or printed.

Are there any penalties for not having an Energy Performance Certificate available?

Failing to comply with these obligations constitutes infractions in matters of consumer defense. Sanctions will range from 200€ to 30.000€.
